Who writes the property inspection report?

How to draw up an act correctly: main points

There is no unified sample act, so it can be drawn up freely. In many ways, the form of the act is dictated by the purpose of creating the document and its content. However, in order for the inspection report of an object to gain legal force, certain standards must be adhered to when registering it.

The document must contain

  • date of compilation,
  • name and address of the location of the object being checked,
  • its condition (if necessary),
  • the objectives of the survey,
  • actions carried out within its framework,
  • as well as the result.

If during the inspection any damage, breakdowns, or defects are revealed (no matter external or internal), they must also be reflected in the document (if possible, indicating the reasons that led to their occurrence). In cases where the survey involves capital construction projects, special attention should be paid to load-bearing structures. At the end of the act you need to write down recommendations, given by the commission to eliminate the identified shortcomings.

If one of the commission members does not agree with the information or conclusions included in the act, he must write his reasoned, informed opinion in the same document as a separate paragraph.

If necessary, various documents confirming its contents (including photographs, links to videos, evidence from independent sources) can be attached to the act, which are drawn up in the form of attachments and must be registered in the act itself.

The object inspection report is drawn up on paper in at least two, and, as a rule, even in several copies (depending on the number of interested parties). It can be filled out either by hand or printed on a computer, but regardless of which design method is chosen, each copy must be certified by the original signatures of the commission members. There is no need to certify the completed form with stamps.

1. Requirements for the preparation of an inspection report (hereinafter - the Requirements) establish the rules for drawing up an inspection act (hereinafter - the Act).

The act is prepared on the basis of information obtained as a result of an inspection of the location of the property, taking into account information from the Unified State Register of Real Estate, as well as other documents confirming the termination of the existence of the property or being the basis for the demolition of the property. The specified documents, with the exception of documents containing information from the Unified State Register of Real Estate, are included in the Appendix to the Act (hereinafter referred to as the Appendix).

If the relevant documents are not included in the Appendix, the reason for their non-use must be given in the line “Conclusion of the cadastral engineer”.

4. All entries except established by law cases are made in the Act in Russian. Numbers are written in Arabic numerals.

5. The Act includes the following information: about the property in respect of which cadastral work is being carried out, about the customer of cadastral work, about the cadastral engineer and the date of preparation of the Act, about the documents used in preparing the Act.

6. The details “Information about the property in respect of which cadastral work is being carried out” indicate information about the type of property and its cadastral number, as well as information about the presence (absence) in the Unified State Register of Real Estate of information about registered rights to the property.

7. The detail “Information about the customer of cadastral work” provides information about the customer of cadastral work:

in relation to an individual - last name, first name, patronymic (the latter - if available), insurance number of an individual personal account (if available);

in relation to a legal entity, government body, local government body, foreign legal entity - full name. In relation to a foreign legal entity, the country of registration (incorporation) is additionally indicated.

8. The details “Information about the cadastral engineer and the date of preparation of the survey report” provide the following information:

1) last name, first name, patronymic (last - if available) of the cadastral engineer;

2) the unique registration number of a member of a self-regulatory organization of cadastral engineers in the register of members of a self-regulatory organization of cadastral engineers and the date of entering information about an individual into such a register;

3) insurance number of an individual personal account in the compulsory pension insurance system of the Russian Federation (SNILS);

9. The detail “List of documents used in preparing the survey report” includes information about the name and details of the documents used in preparing the report, including the following:

1) decisions of the executive authority of a constituent entity of the Russian Federation or municipality on recognition of a property in accordance with the procedure established by law as unsafe and subject to demolition; a document confirming the seizure for state or municipal needs of a land plot with real estate objects located on this land plot that are subject to demolition; a document confirming the development of the built-up area on which the property subject to demolition is located; other documents on the basis of which a decision was made to carry out demolition (dismantling) in the event of forced seizure of a property from the owner;

1.1) a decision on the demolition of an unauthorized building or a decision on the demolition of an unauthorized building or its bringing into compliance with established requirements, adopted by the local government body of the settlement, urban district at the location of the unauthorized building or, if the unauthorized building is located in an intersettlement area, by the local government body municipal district;

2) design documentation of a capital construction project (with the exception of design documentation of linear facilities) in the event of demolition or dismantling of a capital construction project, its parts for construction, reconstruction of other capital construction projects;

3) the decision of the owner of a building, structure, object of unfinished construction (owners of the premises in it) on the demolition of the real estate object (prepared in any written form and signed by such owners, notarization of such a decision is not required) in the case of voluntary demolition of the object not in connection with the establishment of a zone with special conditions for the use of the territory;

4) documents of the executive authority of a constituent entity of the Russian Federation or municipal entity, confirming the fact of natural disasters or other emergency situations in the event of the cessation of the existence of a building, structure, or unfinished construction project due to the destruction of such a real estate object or the cessation of the existence of a premises or parking space in connection with the destruction of the building or structure in which the premises, parking space was located, the destruction of part of the building or structure within which such premises, parking space was located, for reasons beyond the control of the will of the owner of such real estate;

Copies of documents containing information from the Unified State Register of Real Estate are not included in the Appendix.

If the capital construction project ceased to exist after August 4, 2018 as a result of its demolition, information about the notification of completion of the demolition of the capital construction project and the sending of such notification to the local authority is also entered into the “List of documents used in the preparation of the survey report” self-government of a settlement, city district or municipal district at the location of the land plot on which the demolished capital construction project was located.

10. In the detail “Conclusion of the cadastral engineer”, in the form of a coherent text, the conclusion of the cadastral engineer on the termination of the existence of the property is given.

11. The act is prepared in the form of an electronic document in the form of an XML document, certified by an enhanced qualified electronic signature of the cadastral engineer who prepared such a plan, and is issued in the form of files in XML format (hereinafter referred to as the XML document), created using XML schemas and providing reading and monitoring of submitted data.

The composition of the information in the Act in the form of an electronic document must correspond to the composition of the information contained in the approved form of the Act, taking into account the Requirements.

12. XML schemas used to generate XML documents are considered to be put into effect after two months from the date of their placement on the official website of the Federal Service for State Registration, Cadastre and Cartography on the Internet information and telecommunications network at the address: www.rosreestr .ru (hereinafter referred to as the official website).

When changes in regulatory legal acts establishing the form and requirements for the preparation of the Act, the Federal Service for State Registration, Cadastre and Cartography changes the formats of XML documents and XML schemas, while providing on the official website the possibility of public access to the current current version and previous (no longer relevant) ) versions.

The means of enhanced qualified electronic signature of the cadastral engineer must be certified in accordance with the legislation of the Russian Federation and are compatible with the means of qualified electronic signature used Federal service state registration, cadastre and cartography, its territorial bodies.

Information about the requirements for compatibility, a signature key certificate, and ensuring the ability to confirm the authenticity of an enhanced qualified electronic signature of a cadastral engineer is posted on the official website.

13. Documents prepared on paper, which in accordance with the Requirements are to be included in the Appendix, are drawn up in the form of electronic images of paper documents in the form of PDF files, signed with an enhanced qualified electronic signature of the cadastral engineer who prepared the Act.

The electronic image of the document must provide visual identity to its paper original on a scale of 1:1. The quality of the submitted electronic images of documents should allow you to fully read the text of the document and recognize its details. If a paper document consists of two or more sheets, an electronic image of such a paper document is generated in the form of one file. To scan documents, you must use monochrome mode with a resolution of 300 dpi.

If the law allows the preparation of a document to be included in the Appendix in the form of an electronic document, such a document may be included in the Appendix in the form of an electronic document.

An electronic document issued by a government body, local government body, or organization to be included in the Appendix is ​​certified by an enhanced qualified electronic signature of the authorized official such a government body, local government body, organization, and an electronic document prepared an individual, - an enhanced qualified electronic signature of such an individual.

14. The act is also prepared in the form of a paper document, if this is provided for in the contract. An act prepared in the form of a paper document is certified by the signature and seal of the cadastral engineer who prepared such an act. Unfilled details of the Act in the form of a document on paper are not excluded; such details are marked with a “-” (dash).
